To assist Parliamentary scrutiny of the Government’s proposals
for raising the small claims limit for personal injury via
secondary legislation, the Justice Committee has launched a short
inquiry into this topic. The Committee intends to hold a
single oral evidence session early in the New Year and will then
publish a report. In this work the Committee will take account of
published written evidence that was submitted to the previous
Committee’s unfinished inquiry into personal injury: whiplash
and the small claims limit, and of the oral evidence on
this topic taken on 17 February 2017 . There is
therefore no need for previous evidence to be resubmitted to the
Committee.
TERMS OF REFERENCE
Further written submissions may be made, but only if they raise
new points, including points which have arisen from developments
since the previous Committee took evidence, on the following
topics:

· The
impact of raising the small claims limit to £5,000 for
RTA-related whiplash claims, and of raising the small claims
limit to £2,000 for personal injury claims more generally, taking
account of the planned move towards online court procedures

· The
potential impact of this policy on the role of claims management
companies and on the operation of the market for ‘before the
event’ legal expenses insurance
