Secretary of State for Energy Security and Net Zero (): This Statement concerns
an application for development consent made under the Planning
Act 2008 by North Lincolnshire Green Energy Park Limited for
development consent for the construction and operation of a
combined heat and power (CHP) enabled energy generating
development, with an electrical output of up to 95 megawatts
(MWe), incorporating carbon capture, associated district heat and
private wire networks (DHPWN), hydrogen production, ash
treatment, and other associated developments on land at
Flixborough Industrial Estate, Scunthorpe.
Under section 107(1) of the Planning Act 2008, the Secretary of
State must make a decision on an application within three months
of the receipt of the Examining Authority's report unless
exercising the power under section 107(3) of the Act to set a new
deadline. Where a new deadline is set, the Secretary of State
must make a Statement to Parliament to announce it. The current
statutory deadline for the decision on North Lincolnshire Green
Energy Park application is 10 May 2024.
I have decided to set a new deadline of no later than 18 July
2024 for deciding this application. This is to ensure there is
sufficient time for the Department to consider the outcome of the
piece of work being carried out by Defra officials to consider
the role of waste incineration capacity in the management of
residual wastes in England. This follows the Direction issued by
the Defra Minister of State to the Environment Agency on 4 April
to temporarily pause the determination of environmental permits
for new waste incineration facilities up until 24 May 2024.
The decision to set the new deadline for this application is
without prejudice to the decision on whether to grant or refuse
development consent.
