Draft code of practice on right to rent: Right to Rent Scheme for landlords and their agents which sets out the prescribed checks that they should conduct to avoid a civil penalty in the event of renting unlawfully. This code has been laid in draft and will come into force on 22 January 2024 or, if later, the 21st day after the day on which it is made.

All landlords in England have a responsibility to prevent those without lawful immigration status from accessing the private rented sector. They do this by carrying out right to rent checks on tenants before renting a property to them.
